Terms of Use

01 Agreement

These Terms of Use (“Terms”) govern your access to and use of the website operated by Augur LLC (“Augur”, “we”, “us”) at augurdev.com (the “Site”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

02 What these Terms do not cover

These Terms apply to the Site only. Our applications are licensed separately and are governed by their own terms and privacy policies:

• Glim (iOS) — see the Glim terms and Glim privacy policy.

Applications distributed through the Apple App Store are additionally subject to Apple’s own terms.

03 Permitted use

You may view, browse and link to the Site, and quote reasonable excerpts with attribution for commentary, news reporting or similar fair use. You agree not to:

• copy, republish or redistribute substantial portions of the Site’s content, design or code as your own;
• use automated means to scrape or harvest the Site in a way that burdens or disrupts it;
• attempt to gain unauthorised access to the Site or any related system;
• use the Site in violation of any applicable law; or
• use our name, wordmark, logo or product names in a way that suggests affiliation, sponsorship or endorsement that does not exist.

04 Intellectual property

The Site and everything in it — text, design, layout, code, illustrations, renders, and the Augur and Glim names and marks — is owned by Augur LLC or used with permission, and is protected by copyright, trademark and other laws. No licence is granted except as expressly stated in these Terms.

05 Third-party links

The Site links to sites we do not control, including glimcompanion.com and, where relevant, the Apple App Store. We are not responsible for the content, policies or practices of any third-party site, and a link is not an endorsement.

06 Forward-looking statements

The Site describes products in development. Features, timing, availability and pricing described here are subject to change, and nothing on the Site is a promise, commitment or guarantee that any product or feature will be released or will behave in a particular way.

07 No warranty

The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete, accurate or current.

08 Limitation of liability

To the fullest extent permitted by law, Augur LLC and its members, officers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or business, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, statute or otherwise, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

09 Indemnity

You agree to indemnify and hold harmless Augur LLC from any claim, demand, loss or expense (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.

10 Changes

We may modify the Site or these Terms at any time. Revised Terms take effect when posted here, and the date at the top of this page will be updated. Your continued use of the Site after a change means you accept the revised Terms.

11 Governing law

These Terms are governed by the laws of the State of Wyoming and by the federal laws of the United States, without regard to conflict-of-law principles. You agree that the state and federal courts located in the State of Wyoming have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site.

12 General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and Augur LLC regarding the Site.
